Planning Register Part 3: Local Development Orders

The Town and Country Planning (Development Management Procedure) (England) Order 2015 (Sections 40 to 42) requires each local authority to keep a register of every application for planning permission relating to their area (parts 1 and 2 of the register).

In part 3 of the register, Section 41 requires details of Local Development Orders (both which have been prepared but not adopted and those which have been adopted) to be published. 

Part 4 of the register should contain details on Neighbourhood Development Orders.

The are no Neighbourhood Development Orders with the borough. There are currently no draft LDOs in production.

Local Development Orders

21 to 32 (consecutive) Redcliffe Road, SW10.  Mansard roof additions

On 22 April 2024 the Council confirmed a Local Development Order for mansard roof additions for Nos. 21 to 32 Redcliffe Road, SW10 9NP.

This means that specific planning permission is not needed for a new mansard as long as: 

  • it is of a design/ constructed of materials which comply with the Redcliffe Road Local Development Order Design Brief; 
  • the bottle balustrade to the front parapet is reinstated; and 
  • the new mansard includes the provision of photovoltaic panels.

In addition for the mansard to be permitted by the LDO, its construction must comply with an agreed Code of Construction Practice and an agreed Construction Traffic Management Plan.  

The LDO, including a map of the properties affected, the Statement of Reasons, the Design Brief and details of the Council’s Code of Construction Practice and Construction Traffic Management Plan can be viewed here.

The LDO will last 10 years from its adoption, or to 22 April 2034.

There is no planning fee for building a mansard under the provisions of this LDO.  

Owners must contact the Council on completion of the mansard so that the Council can check that the development meets the necessary requirements. Any extension which does not meet all the provisions of the LDO does not benefit from planning permission.

Owners may wish to apply for a separate Certificate of Lawful Development if they require confirmation that the development meets the requirements of the LDO.  

It is important to note that the LDO replaces the need for a separate planning permission only. It does not nullify the requirements of the Party Wall Act or of Building Regulations.
