Conditions and reasons:

The proposed development would reduce both the number and range of affordable housing units available in the borough, undermining the Council's ability to meet its housing needs, contrary to policies CH2 and CH3 of the Consolidated Local Plan and London Plan policies 3.10, 3.11, 3.12 and 3.13.

2)

In the absence of a suitable legal agreement to ensure that the full benefits of the proposals, including funding the redevelopment of sheltered accommodation for the elderly at Chelsea Court, delivering social rented homes at 40-41 Nevern Square, and securing the units at 40-41 Nevern Square as affordable rent in perpetuity, there are insufficient benefits to outweigh the harm that would arise from the loss of affordable homes. The proposal is contrary to the policies of the Development Plan, specifically policies CH2 and CH3 and the Planning Obligations SPD.

To assist applicants in finding solutions to problems arising in relation to their development proposals the Local Planning Authority has produced planning policies, and provided written guidance, all of which are available on the Council's website, and offers a pre-application advice service. Pre-application advice was sought and provided, and improvements recommended during assessment of the application. Unfortunately this advice was not adhered to. Nevertheless, the Council is ready to enter into discussions with the applicants through the advice service to assist in the preparation of a new planning application.
