Personal Land Charge Searches
A Personal Search is only a copy of all the registrations that
are held on the Local Land Charges Register against the address
provided. It does not include supplementary or additional
information. The contents of a Personal Search are unchecked and
unofficial. The information is unsorted and provided in its raw
state and it is the responsibility of the customer to decide what
is relevant and what is not.
Personal searches may be undertaken by searchers in person or
can be provided by the Council upon request.
Inspection of the information in person can be undertaken at the
Planning Information Desk at the Town Hall and is by appointment
only. Appointments will be made available within 20 working days of
the request to inspect being made. The information may be inspected
on the premises free of charge under Environmental Information
Regulations (EIR), however photocopies of documents taken as part
of the personal search, or printing of archive documentation, will
be charged at current fee rates.
Responses to requests under EIR for Personal Searches to be
provided in writing will be dispatched within 20 working days of
the request being registered by the Land Charges Team; this service
is free of charge. An expedited service is available whereby the
response will be provided within five working days, often sooner,
for a fee of £25. If you wish to take advantage of the expedited
service, payment must be made upon collection.
PLEASE NOTE - There is a restriction on the
number of expedited searches which can be booked for any one day
and there is a restriction on how many can be booked by one company
/ individual. If we cannot accommodate your request because
bookings are full or because you have reached your allocation, we
will contact you upon receipt.
Cheques should be made payable to ‘The Royal Borough of
Kensington and Chelsea’.
Requests for Personal Searches must be made by e-mail
to: Personal.Searches@rbkc.gov.uk
It is also possible for personal searchers to obtain information
relating to the CON29R from Local Land Charges. This is a
chargeable service and costs £17.

Changes to legislation with effect from 17 August 2010
Since the government change in legislation governing
Personal Searches, claims may be made for refunds of fees paid
for personal searches in this and previous financial years. However
in the case of fees paid by Personal Search companies, these have
usually been passed on to clients, and therefore we have been
advised any repayment to firms would constitute unjust enrichment.
Therefore we have no plans to offer refunds to property search
companies.
Other claims will be considered on their merits but given that
the fee concerned was a mandatory, statutory fee which
this authority was obliged to implement, any claims for refunds
should in the first instance be directed to the Ministry of
Justice.
