Mezcal Reina Limited, 57 Holland Road, London, W14 8HL (“the Premises”)

The Committee has considered an application for a grant of a premises licence under the Licensing Act 2003 in respect of the above Premises.

The Committee has considered the committee papers and the submissions made by all of the parties, both orally and in writing.

In reaching its determination, the Committee has had regard to the relevant legislation, the Secretary of State’s Guidance (“Guidance”) and the Licensing Authority’s Statement of Licensing Policy (“SLP”).

In summary, the Committee has determined, after taking into account all of the individual circumstances of this case and the promotion of the four licensing objectives:-

 

1.    To grant permission for the sale by retail of alcohol off the Premises:- 

        Monday to Sunday                    from 08:30 to 18:00

       

2.     The licence is subject to the following conditions proposed by the Applicant (some of which were amended by the Committee with the Applicant’s agreement), namely:-

 

2.1           All sales of alcohol shall be in sealed containers only.

 

2.2           No members of the public will be allowed on the Premises.

 

2.3   All off-sales of alcohol shall at all times be via a pre-ordered delivery service arranged and kept within the control of the Premises Licence Holder (for the avoidance of doubt, customers will not be permitted to collect alcohol from outside the Premises).

 

2.4   All alcohol kept at the Premises shall be stored in a lockable room in the basement vault area.

 

2.5           All staff involved in the sale or supply of alcohol will receive training in relation to their responsibilities under the Licensing Act 2003. Refresher training shall be carried out at least every twelve months.

 

2.6           Signed and dated training records shall be kept on the Premises (or otherwise be accessible at the Premises) for a minimum of 12 months from the last date of entry and made immediately available for inspection to police, trading standards or licensing authority staff upon reasonable request.

 

2.7           Deliveries shall be refused to any person who is, or who appears to be, under the influence of alcohol or drugs and the alcohol shall be returned to the Premises.  The following details must be recorded in relation to any refusal:

 

a)    Date and time of refusal

b)    Address of refused delivery

c)    Reason for refusal

d)    Name of the staff member refusing to supply the alcohol

 

2.8           Deliveries to and from the Premises shall not take place between 18:00 and 08:30 the following day on Mondays to Sundays.  There shall be a member of staff from the Premises available to oversee all deliveries.
