Conditions and reasons:

1)

Time Limit The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
Reason - As required by Section 91 of the Town and Country Planning Act 1990, to avoid the accumulation of unexercised Planning Permissions.

2)

Compliance with approved drawings The development shall not be carried out except in complete accordance with the details shown on submitted plans
Reason - The details are material to the acceptability of the proposals, and to ensure accordance with the development plan.

3)

Limit on hours The use of the Restaurant shall not begin before 07:00 and shall cease no later than 23.30 daily. Outside of these approved hours the restaurant shall be closed to patrons.
Reason - To prevent detriment to the living conditions within nearby residential properties in order to accord with the development plan, in particular policies CT1 and CL5 of the Consolidated Local Plan.

4)

Number of covers The number of internal covers comprised within the uses hereby permitted shall be limited to 90 at any one time.
Reason - To prevent detriment to the living conditions within nearby residential properties in order to accord with the development plan, in particular policy CL5 of the Consolidated Local Plan.

Management Plan The development hereby permitted shall only be operated in accordance with the Management Plan set out in Schedule 2 of the Supporting Planning Statement Addendum dated July 2018.
Reason - To prevent detriment to the living conditions within nearby residential properties in order to accord with the development plan, in particular policies CT1 and CL5 of the Consolidated Local Plan.

Noise Limits Between 19:00 and 23:00 hours, noise from the 4th floor roof terrace, including music and sounds of patrons, shall cause no increase in the LAeq5min or more than a 2dBA increase in the Leq5min both in the 63Hz and 125Hz octave bands measured or predicted 1.0m from the nearest noise sensitive or residential fa╪ade or at 1.2m above any adjacent garden, terrace, balcony or patio. For all other octave bands there shall be no increase. Between 23:00 to 07:00 hrs, noise from the 4th floor roof terrace, including music and sounds of patrons, shall cause no increase in the LAeq5min or Leq5min in all third octave frequency bands measured or predicted at 1.0m from the nearest noise sensitive or residential fa╪ade.

7)

Noise Mitigation In order to comply with Condition 6, an imperforate acoustic screen, of at least 2 metres in height, shall be installed on the 4th floor roof terrace prior to first use of the restaurant and in accordance with the specification and recommendations of the Acoustic Report (prepared by WSP UK Limited, dated January 2018), and the submitted acoustic screen drawing (ref. 16992-P059A). The recommendations of the report shall be adopted and implemented in full.
