1)
Time Limit
The development hereby permitted shall be begun before the expiration of three years from the grant of planning permission PP/13/03968 on 13th September 2013.
Reason - As required by Section 91 of the Town and Country Planning Act 1990, to avoid the accumulation of unexercised Planning Permissions.
2)
Compliance with approved drawings
Except as required by condition 28, the development shall not be carried out except in complete accordance with the details shown on submitted plans
Reason - The details are material to the acceptability of the proposals, and to ensure accordance with the development plan.
3)
Submission of details (Full PP)
The development shall be carried out in accordance with the details of materials approved under application CON/14/08723.
Reason - To accord with the development plan by ensuring that the character and appearance of the area are preserved and living conditions of
those living near the development suitably protected.
4)
Construction Traffic Management Plan (CTMP)
The development shall be carried out in accordance with the approved Construction Traffic Management Plan (WL-PB-SSK-001,CTMP) prepared by Walter Lilly Ltd issued 2014-12-20 and the associated plans 1635/26/003 Rev. C and 1635/26 Fig. 5.1, approved under application CON/14/08850.
Reason - To minimise the impact of construction works upon highway safety and nearby residents' enjoyment of their properties in accordance with the Subterranean Development SPD and policies CT1 and CL5 of the Core Strategy.
5)
Flood Risk
The development shall incorporate the mitigation measures as set out in the Flood Risk Assessment prepared by Water Environment Limited, dated 18th September 2014.
Reason - To protect future occupants from the risk of basement flooding.
6)
Ecological Management Plan
The development shall be carried out in accordance with the details contained in the Biodiversity Management Plan, prepared by MLA Ecology Limited, dated 10th February 2014, approved under application CON/14/04082.
Reason - To ensure the protection of wildlife and supporting habitat and secure opportunities for the enhancement of the nature conservation value of the site in line with national planning policy.
7)
Materials - To match existing
All work and work of making good shall be finished to match the existing exterior of the building(s) in respect of materials, colour, texture, profile and, in the case of brickwork, facebond and pointing, and shall be so maintained.
Reason - To preserve or enhance the appearance of the building and/or the character of the area in accordance with policies of the development plan in particular policies CL1, CL2, CL3 and CL6 of the Core Strategy.
8)
Professional management of engineering works
The construction works shall be supervised throughout their duration by Michael Coombs (BSc MSc DIC FIStructE MCONSE) of Alan Baxter & Associates LLP. In the event that the appointed engineer ceases to perform that role for whatever reason before the construction works are completed those works will cease until a replacement Chartered Civil Engineer (MICE) or Chartered Structural Engineer (MI Struct.E) has been appointed to supervise their completion and their appointment confirmed in writing to the Local Planning Authority. At no time shall any construction work take place unless an engineer is at that time currently appointed and their appointment has been notified to this Authority in accordance with this condition.
Reason - The details are considered to be material to the acceptability of the proposal, and for safeguarding the amenity of neighbouring residential properties and to comply with the Subterranean Development SPD and policy CL7 of the Core Strategy.
9)
Considerate Constructors Scheme (CCS)
No development shall commence until such time as the lead contractor, or the site, is signed to the Considerate Constructors Scheme (CCS) and its published Code of Considerate Practice, and the details of (i) the membership, (ii) contact details, (iii) working hours as stipulated under the Control of Pollution Act 1974, and (iv) Certificate of Compliance, are clearly displayed on the site so that they can be easily read by passing members of the public, and shall thereafter be maintained on display throughout the duration of the works forming the subject of this permission.
Reason - To mitigate the impact of construction work upon the levels of amenity that neighbouring occupiers should reasonably expect to enjoy, and to comply with the Subterranean Development SPD and policy CL5 of the Core Strategy. It is necessary for the condition to be on the basis that 'No development shall commence until' as compliance with the requirements of the condition at a later time would result in unacceptable harm contrary to the policies of the Development Plan.
10)
Sash windows and doors in painted timber
All new windows and external doors to Gordon House, the Orangery and Creek Lodge hereby permitted shall be of white painted timber and windows shall be single glazed with a bevelled putty finish and no trickle vents, and so maintained.
Reason - To preserve or enhance the appearance of the building and/or the character of the area, in accordance with policies of the development plan in particular policies CL1, and CL2 of the Core Strategy.
11)
Trees and landscaping - Details required
The development hereby permitted shall not be occupied until the hard and soft landscaping forming part of this development has been carried out in accordance with the details contained within the Landscape Design Statement prepared by applied landscape design, Report ALD633_RP910 Rev. P08 dated February 2015.
Reason - To protect the appearance and amenity of the area and to accord with policies of the development plan, in particular policy CR6 of the Core Strategy. ÿ
12)
Planting and replanting
All tree and shrub planting forming part of the plans and details approved through this planning permission shall be carried out in the first planting and seeding season following the first occupation of the development or the completion of the development whichever is the sooner. Any trees or shrubs which, within a period of five years from the first planting and seeding season referred to above, die, are removed, or become seriously damaged or diseased, shall be replaced in the next planting season with others of similar size and species.
Reason - To protect the appearance and amenity of the area and to accord with policies of the development plan, in particular policy CR6 of the Core Strategy.
13)
Bat/bird nesting boxes
Details of no fewer than 25 bird and bat nesting boxes / bricks, including the exact location, specification and design, shall be submitted to and approved in writing by the Local Planning Authority prior to the relevant part of the works commencing on site. The development shall not be occupied unless the boxes / bricks have been installed. The nesting boxes / bricks shall be installed strictly in accordance with the details so approved and shall be maintained as such thereafter.
Reason - To ensure the development provides the maximum possible provision towards creation of habitats and valuable areas for biodiversity in accordance with policies: 7.19; of the London Plan (as amended) and Core Strategy Policy CE4.
14)
Update to bat survey - If required
If more than one year passes between the most recent bat survey and the commencement of demolition and/or tree works, an updated bat survey must be undertaken immediately prior to demolition or tree works by a licensed bat worker. Evidence that the survey has been undertaken shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of demolition and/or tree works.
Reason - To ensure compliance with the Habitats Regulations and the Wildlife & Countryside Act 1981 (as amended).
15)
Works to Grotto and chimney voids
Works to the Grotto and chimney voids should not be undertaken in the winter months (between November and February inclusive) unless otherwise approved in writing by the Local Planning Authority.
Reason - To ensure compliance with the Habitats Regulations and the Wildlife & Countryside Act 1981 (as amended).
16)
Details of proposed pond
Details of the scheme for the proposed pond, which includes the plants to be installed within the water features, shall be submitted to and approved in writing by the Local Planning Authority prior to the relevant part of the works commencing on site and prior to occupation. The pond, which should not be stocked with fish, shall be constructed in accordance with the approved details and so maintained.
Reason - All wild birds, their nests and young are protected during the nesting period under The Wildlife and Countryside Act 1981 (as amended).
17)
Removal of vegetation
No trees, hedgerows, shrubs, scrub or tall herbaceous vegetation shall be removed except between the months of September and February inclusive unless otherwise approved in writing by the Local Planning Authority.
Reason - All wild birds, their nests and young are protected during the nesting period under The Wildlife and Countryside Act 1981 (as amended).
18)
Noise from building services plant and vents
Noise emitted by all building services plant and vents shall not exceed a level 10dBA below the existing lowest LA90(10min) background noise level at any time when the plant is operating, and where the source is tonal it shall not exceed a level 15dBA below. The noise emitted shall be measured or predicted at 1.0m from the facade of the nearest residential premises or at 1.2m above any adjacent residential garden, terrace, balcony or patio. The plant shall be serviced regularly in accordance with the manufacturer's instructions and as necessary to ensure that the requirements of the condition are maintained. If at any time the plant is determined by the local planning authority to be failing to comply with this condition, it shall be switched off upon written instruction from the local planning authority and not used again until it is able to comply.
Reason - To prevent any significant disturbance to residents of nearby properties and comply with development plan policies, in particular policy CL5 of the Core Strategy.
19)
Anti-vibration mounts for air-conditioning/ extraction equipment
The plant shall not operate unless it is supported on adequate proprietary anti-vibration mounts to prevent the structural transmission of vibration and regenerated noise within adjacent or adjoining premises, and these shall be so maintained thereafter.
Reason - To prevent any significant disturbance to residents of nearby properties and comply with development plan policies, in particular policy CL5 of the Core Strategy.
20)
Odours from swimming pool ventilation/ filtration equipment
Fumes or odours expelled from any flue serving the hygiene plant or providing ventilation to the swimming pool area shall not be detectable at the property boundary. If at any time the extraction plant is determined by the local planning authority to be failing to comply with this condition, it (or the source equipment) shall be switched off and not used again until it is able to comply.
Reason - To prevent any significant disturbance to residents of nearby properties and comply with development plan policies, in particular policy CL5 of the Core Strategy.
21)
Parking
The car parking spaces shown on the approved plans shall be permanently retained for the parking of vehicles in connection with the residential use of the dwelling and for no other purposes.
Reason - To safeguard the amenity of the area.
22)
Provide cycle storage
Cycle parking shall be provided in accordance with the details as shown on drawing number 110 Rev. B and shall be maintained thereafter.
Reason - To ensure the safe and sustainable movement of traffic on neighbouring highways, in accordance with policies of the development plan in particular policy CT1 of the Core Strategy.
23)
Protection of trees during construction
The tree protection measures shown on drawing 11381_A3/TPP/01 shall be provided before the commencement of the development and maintained for the duration of building and other operations on site.
Reason - To ensure that the trees are adequately protected, to safeguard their contribution to theÿappearance and amenity of the area and accord with policies of the development plan, in particular policy CR6 of the Core Strategy.
24)
Black painted railings
The railings to the terraces and walls hereby permitted shall be painted black, and so maintained.
Reason - To preserve or enhance the appearance of the building and/or the character of the area, in accordance with policies of the development plan in particular policies CL1, and CL6 of the Core Strategy.
25)
Works to match - Sample panels required
The development shall be carried out in accordance with the details of the new brickwork, including the rebuilt brick arches, showing the proposed colour, texture, facebond and pointing approved under application CON/14/04082. The sample panels shall be retained on site until the work is completed in accordance with the panel(s) so approved.
Reason - In order to safeguard the special architectural or historic interest and heritage significance of the building
26)
Archaeology - Watching brief
The development shall be carried out in accordance with the detailed scheme contained within the Written Scheme of Investigation for an archaeological watching brief and programme of archaeological mitigation, prepared by Museum of London Archaeology (MoLa), dated 8th July 2014, approved under application CON/14/04390.
Reason - To minimise any damage to any archaeological remains that may exist on site and to ensure satisfactory recording in accordance with policy CL4 of the Core Strategy.
27)
Archaeology - Investigation
The development shall take place in accordance with the Written Scheme of Investigation for an archaeological watching brief and programme of archaeological mitigation, dated 8th July 2014, Written Scheme of Investigation for an Archaeological Evaluation and Standing Building Recording, dated 2nd July 2014, Summary Statement of the Archaeological Evaluation and Standing Building Recording, dated 8th July 2014, Subterranean brick vaults at Gordon House, Royal Hospital, Chelsea, London, SW3, A Detailed Desk Based Assessment, dated April 2013 and Gordon House, The Royal Hospital Chelsea, London SW3, Historic environment assessment, dated April 2014, all prepared by Museum of London Archaeology (MoLa), and approved under application CON/14/04390.
Reason - To safeguard the archaeological heritage of the Borough in accordance with policy CL4 of the Core Strategy.
28)
Door - Inward opening
Notwithstanding the details shown on the approved plans, the lower ground floor external door to the east wing shall be inward opening only, and so maintained.
Reason - To accord with the development plan by ensuring that the character and appearance of the area are preserved.
