Conditions and reasons:

1)

Time Limit The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
Reason - As required by Section 91 of the Town and Country Planning Act 1990, to avoid the accumulation of unexercised Planning Permissions.

2)

Compliance with approved drawings The development shall not be carried out except in complete accordance with the details shown on submitted plans
Reason - The details are material to the acceptability of the proposals, and to ensure accordance with the development plan.

3)

Hours of operation - Any day The use shall not be carried out other than between 10.00 hours and 00.00 hours, on any day.
Reason - To prevent any significant disturbance to residents of nearby properties and comply with development plan policies, in particular policy CL5 of the Consolidated Local Plan.

4)

Number of covers The number of internal covers comprised within the uses hereby permitted shall be limited to 75 at any one time.
Reason - To prevent detriment to the living conditions within nearby residential properties in order to accord with the development plan, in particular policy CL5 and CE6 of the Consolidated Local Plan.

5)

Submission of details - Management Plan The wine bar hereby approved shall not be occupied until a management plan (referred to in the planning statement accompanying this application), which has particular regard to managing arrivals and departures of patrons, has been submitted to, and approved in writing by, the local planning authority. The management plan shall be monitored and reviewed in accordance with any targets within the plan, and such record made available upon request by the local planning authority.
Reason - To accord with the development plan by ensuring that the living conditions of those living near the development suitably protected.

Limited period (Use) The permitted A4 use shall be retained for a limited period only of one year from the date of written approval from the local planning authority of the details required under condition 5 (management plan), on or before which date the use shall be discontinued.
Reason - To allow the authority to reassess the impact of the development in the light of experience of the use and ensure there is no conflict with the development plan, in particular policies CL5 of the Consolidated Local Plan.

The occupier of the new wine bar is reminded that they would need to apply for a premises licence for the proposed use, and that additional conditions to promote the prevention of public nuisance will be considered. The grant of planning permission would not permit unacceptable noise nuisance at the premises.

Condition number 5 imposes requirements which must be met prior to occupation of the new wine bar. Failure to observe these requirements could result in the Council taking enforcement action.
