Conditions and reasons:

In the absence of the present condition 4, or a legal agreement under s.106 to achieve the same, there would be a significant potential for one property in the pair to construct an extension in their half of the shared lightwell without the other following suit, with a consequent material increase in the sense of enclosure experienced within the rear ground floor of the second property. As such, the proposal to remove or alter condition 4 is contrary to policy CL5 (d) of the Consolidated Local Plan without any mitigating circumstance that would enable planning premission to be granted.

Pre-application advice was sought and provided, and improvements recommended during assessment of the application. Unfortunately this advice was not adhered to. Nevertheless, the Council is ready to enter into discussions with the applicants through the advice service to assist in the preparation of a new planning application.
