What is a Section 58 restriction?

A Section 58 is a legal notice which is served on all the 'statutory undertakers' who carry out work in the borough. Statutory undertakers can include the following type of companies – Thames Water, British Telecom, Virgin Media, EDF Energy, National Grid.

The Section 58 prevents 'statutory undertakers' from digging up the road for a period of between 3-5years after the road has been resurfaced or reconstructed. In special cases 'statutory undertakers' can dig up a road if there is an emergency or if they need to provide a new customer service.
