Section 50 licence - draft

 If you want to do any of the following activities in the highway you will need a Section 50 licence:

• place, or to retain, apparatus in the street, and
• inspect, maintain, adjust, repair, alter or renew the apparatus, change its position or remove it

Apparatus can include such things as drains, sewer pipes, gas pipes, water pipes, ducts and cables.

The council has the right to refuse to grant a licence where it is perceived that either:

• highway users may be unnecessarily disrupted or obstructed
• safety may be compromised
• the structural integrity of the street or apparatus may be jeopardised

Section 50 licences are typically only granted for the installation of apparatus which cross the road. The council reserves the right to refuse applications that involve the installation of apparatus along the road or several roads. The council will review this position if satisfactory evidence is provided by the applicant to confirm the apparatus will be adopted by the relevant statutory undertaker.
