Fly tipping
It is an offence, punishable by imprisonment of up to twelve months, to dump or 'fly tip' material on the highway. If you have any information regarding fly tipping, such as the vehicle registration number or owner’s name, use the Report it form.
Enforcement
Dumping waste or litter on the street is an offence under the Environmental Protection Act 1990. The Council may issue a Fixed Penalty Notice of £300 for littering under sections 87/88, or £1,000 for fly-tipping/depositing controlled waste under section 33. Reduced payment amounts may apply where payment is made within 14 days.
Where an FPN is not paid, or where prosecution is considered appropriate, the matter may be referred for legal action. On conviction, littering carries a maximum fine of £2,500, while fly-tipping offences can result in a fine of up to £50,000 and/or up to 12 months’ imprisonment on summary conviction, or an unlimited fine and/or up to five years’ imprisonment on conviction on indictment.
