Commercial Waste Time Banding Notice
Placing receptacles for trade waste on certain streets within the Royal Borough of Kensington and Chelsea.
Section 47 of the Environmental Protection Act 1990
(as amended by sections 21 and 22 of the London Local Authorities Act 2007)
Notice is hereby given that on 11 March 2025, the Royal Borough of Kensington and Chelsea (“the Council”) shall make regulations relating to the placement and collection of commercial or industrial waste, in line with Sections 21 and 22 of the London Local Authorities Act 2007. It is the intention of the Council, being satisfied that doing so would prevent nuisance or detriment to the amenities of their area, to make the following requirements as to the number, type and size of receptacles as well as periods during which receptacles may be placed on the highway.
The regulations defined within this Notice relate specifically to the following Highway/s:
- Brompton Road
- Earl’s Court Road
- Fulham Road
- Gloucester Road
- Kensington High Street
- King’s Road
- Ladbroke Grove (between Lancaster Road and Cambridge Gardens)
- Notting Hill Gate
- Sloane Street
The Notice requires compliance with the following stipulations:
i. Occupiers of premises to place commercial or industrial waste for collection in receptacles which clearly identify the waste collection service provider.
ii. On streets covered by the Council’s Time Banding Scheme (called “Clear Streets”), waste receptacles shall only be placed on the highway at the specified times shown on the Council’s website. Streets within the scheme are indicated on the Council’s website. If the waste is not collected within the times specified on the website, then it must be removed from the street at the end of the collection period.
iii. On streets, which are not covered by the Council’s Time Banding Scheme, waste receptacles can be placed on the highway at any time but must be collected within one hour from presentation on the highway. If the waste is not collected after one hour from presentation it must be removed from the street.
iv. On streets which are not covered by the Council’s Time Banding Scheme but on which waste is collected by the Council, waste receptacles must be placed on the highway at the times scheduled for collection by the Council. If the waste is not collected within the times specified on the website, then it must be removed from the street at the end of the collection period
The Council’s waste collection schedule can be viewed at the following website: www.rbkc.gov.uk. The Council can also confirm whether a street is covered in the Time Banding Scheme by calling 020 7361 3001 or emailing [email protected].
It should be noted that the above conditions relate to Monday-Sunday for the entire seven day period.
The proposed order will come into effect as of 11 March 2025, which is not earlier than the expiration of one month from the publication of this notice.
A person who fails, without reasonable excuse, to comply with any requirements imposed under this notice shall be liable on summary conviction to a fine not exceeding level 3 on the standard scale.
