Planning Register Part 3: Local Development Orders (LDO)

The Town and Country Planning (Development Management Procedure) (England) Order 2015 (Sections 40 to 42) requires each local authority to keep a register of every application for planning permission relating to their area (parts 1 and 2 of the register).

In part 3 of the register, Section 41 requires details of LDOs (both which have been prepared but not adopted and those which have been adopted) to be published. 

Part 4 of the register should contain details on Neighbourhood Development Orders.

The are no Neighbourhood Development Orders with the borough. There are currently no draft LDOs in production.

Local Development Orders

21 to 32 (consecutive) Redcliffe Road, SW10.  Mansard roof additions

On 22 April 2024 the Council confirmed a LDO for mansard roof additions for Nos. 21 to 32 Redcliffe Road, SW10 9NP.

This means that specific planning permission is not needed for a new mansard as long as: 

  • it is of a design/ constructed of materials which comply with the Redcliffe Road LDOr Design Brief; 
  • the bottle balustrade to the front parapet is reinstated; and 
  • the new mansard includes the provision of photovoltaic panels.

In addition for the mansard to be permitted by the LDO, its construction must comply with an agreed Code of Construction Practice and an agreed Construction Traffic Management Plan.

The LDO will last 10 years from its adoption, or to 22 April 2034.

There is no planning fee for building a mansard under the provisions of this LDO.  

Owners must contact the Council on completion of the mansard so that the Council can check that the development meets the necessary requirements. Any extension which does not meet all the provisions of the LDO does not benefit from planning permission.

Owners may wish to apply for a separate Certificate of Lawful Development if they require confirmation that the development meets the requirements of the LDO.  

It is important to note that the LDO replaces the need for a separate planning permission only. It does not nullify the requirements of the Party Wall Act or of Building Regulations. 

Replacement windows in residential properties

On 23 October 2025 the Council confirmed a LDO for alterations to windows in non-listed buildings across the borough.

This means that specific planning permission is not needed for replacement windows in a residential property as long as:

  • The replacement window is of similar appearance to the existing. Similar appearance is defined within the Council's Householders Guide to Windows, which you can view in Sustainability retrofitting your home.
  • Any window at first floor level or above (including within a dormer) which is currently obscure-glazed, is replaced with an obscure-glazed window to an equivalent specification.
  • Any window at first floor level or above (including within a dormer), which is currently non-opening is replaced with a non-opening window unless the parts of the window which can be opened are more than 1.7m above the floor of the room in which the window is installed.

The LDO permits uPVC windows in residential properties to be replaced with windows made of wood, but does not permit wooden windows to be replaced with windows made of uPVC.

This LDO overrides any Article 4 Directions currently in force which otherwise remove permitted development rights for changes to windows.

The LDO does not allow:

  • the addition of a reflective film to a window where this would materially affect the appearance of that window
  • replacing a clear of obscure glazed window with a mirrored window
  • alterations to windows with listed buildings
  • alterations with conservatories
  • alterations to rooflights, glazed or solid doors

There is no planning fee for altering a window under the provisions of this LDO.

There is no need for a property owner to notify the Council of their intention to make use of the LDO. However, if the altered window does not meet the requirements of the LDO planning permission may be required.

Owners may wish to apply for a separate Certificate of Lawful Development if they require confirmation that the development meets the requirements of the LDO. This will be subject to the usual fees.

The LDO replaces the need for a separate planning permission only. It does not nullify the requirements of Building Regulations.
