Conditions and reasons:

1)

The existing cinema, including the provision of a single large auditorium, provides an important cultural and community facility essential to the character and attractiveness of King's Road, Chelsea and the Borough as a whole. The replacement cinema would not be to an equivalent or better standard and would therefore be contrary to the policies of the development plan, in particular Policy CF7 of the Core Strategy adopted 8 December 2013.

The Trafalgar Public House provides an important social and community facility essential to the character and attractiveness of King's Road, Chelsea. The proposed Public House on Chelsea Manor Street would not be of the same value to the local community and character of the area, partly due to its relocation, contrary to the policies of the development plan, in particular Core Strategy Policy CK2.

The applicant has failed to demonstrate to the satisfaction of the Local Planning Authority, by reason of the lack of detailed information, that the proposed roof top plant above the rear of 196 - 198 King's Road would not be unduly prominent in views from the rear of houses of nearby residents, in particular those living in Burnsall Street, thereby harming their living conditions. In the absence of this information, the proposals are contrary to Core Strategy Policy CL5.

In the absence of a completed satisfactory section 106 agreement, the proposed development fails to secure the maximum reasonable amount of affordable housing and would therefore be contrary to the policies of the development plan, in particular Policies CH1 and CH2 of the Core Strategy adopted 8 December 2013 and London Plan policies 3.12 and 3.13.

In the absence of a completed satisfactory section 106 agreement to secure the necessary planning obligations, the applicant has failed to demonstrate that the proposed development would not result in unacceptable pressure on local infrastructure (including education, health and community facilities) and on-street car parking facilities and would therefore be contrary to policies of the development plan, in particular policies C1 and CT1 of the Core Strategy adopted 8 December 2013, the Transport Supplementary Planning Document adopted 10 December 2008 and the Planning Obligations Supplementary Planning Document adopted 17 August 2010.

To assist applicants in finding solutions to problems arising in relation to their development proposals the Local Planning Authority has produced planning policies, and provided written guidance, all of which are available on the Council's website, and offers a pre-application advice service. Pre-application advice was sought and provided, and improvements recommended during assessment of the application. Unfortunately this advice was not adhered to. Nevertheless, the Council is ready to enter into discussions with the applicants through the advice service to assist in the preparation of a new planning application.
