Conditions and reasons:

The proposed extension of hours of operation of the restaurant would result in a significant increase in late night noise and disturbance in the vicinity of the premises to the detriment of residential amenity. This is contrary to the Council's development plan policy as stated in the Core Strategy in particular policies CL5 and CE6 and in the Unitary Development Plan in particular Policy H4.

You are advised that this application was determined by the Local Planning authority with regard to Development Plan policies including relevant policies contained within the London Plan Spatial Development Strategy for Greater London adopted July 2011; the Core Strategy adopted 8 December 2010 and the 'Saved' policies of the Unitary Development Plan adopted 25 May 2002.

The basement of 225A is not part of the application site for Planning permission PP/06/03004. It is shown on the submitted basement drawing as part of the restaurant but cannot be included in the current application to vary conditions of the above planning permission. Council records indicate that the lawful use of 225A is as a basement and ground floor shop. Planning permission is required for change of use of the basement of 225A from Class A1 shop to Class A3 restaurants and cafes. This requires a separate planning application and the merits of loss of the shop use are not addressed in this application.
