Conditions and reasons:

1)

The height and mass of the proposed building would be overly dominant in the surrounding area, particularly when viewed from Freston Road and Bard Road. The proposals are contrary to policies of the Consolidated Local Plan, in particular policies CL1 and CL2

2)

The proposed building would reduce the levels of daylight enjoyed within the flats of Cian House by an unacceptable amount, and cause an unacceptable increase in the sense of enclosure experienced by these residential occupiers, contrary to the Consolidated Local Plan, in particular policy CL5.

3)

The Curve on Bard Road is an essential part of the Council's response to the Grenfell Fire tragedy, and is the only such Council-run facility in the north of the Borough. Every day many individuals and families come to The Curve to receive support and help dealing with symptoms of post-traumatic stress disorder and other forms of trauma. The construction of the proposed development adjacent to The Curve would unreasonably impact on the function of The Curve and the recovery of the individuals and families it serves.

In the absence of agreed obligations under section 106 of the Town and Country Planning Act 1990 which would secure the mitigation measures and infrastructure which are necessary to make the development acceptable, the proposal would be contrary to policies of the London Plan, in particular policies 3.12 and 3.16, and the Consolidated Local Plan, in particular policies C1, CT1 and CR4.

You are advised that this application was determined by the Local Planning authority with regard to Development Plan policies including relevant policies contained within the London Plan 2015 (Consolidated with Alterations since 2011); the Consolidated Local Plan 2015 and the 'Saved' policies of the Unitary Development Plan adopted 25 May 2002.

Refused despite pre-app advice
To assist applicants in finding solutions to problems arising in relation to their development proposals the Local Planning Authority has produced planning policies, and provided written guidance, all of which are available on the Council's website, and offers a pre-application advice service. Pre-application advice was sought and provided, but permission ultimately refused. The Committee understood the need for additional office accommodation to serve the borough and London as a whole, the generic benefits that would result from the development and that the principle of development complied with the Development Plan. However, in this particular case it was sufficiently concerned about the scale of development, its impact on the area and nearby residents and crucially its impact on those who use The Curve to conclude that these specific, local impacts outweighed the generic benefits resulting from the proposal. Nevertheless, the Council is ready to enter into discussions with the applicants through the advice service to assist in the preparation of any new/reduced application in the future.
