Conditions and reasons:

The proposal by reason of its bulk, height, mass, scale and form would represent a cramped and contrived form of development, at odds with the established pattern of development in the local area. Closing the gap between 294 Old Brompton Road and 1 Warwick Road further compounds this and blurs the important distinction between the two buildings and views between them. As a result, the development fails to preserve or enhance the character and appearance of the conservation area, contrary to Local Plan Policies CL1, CL2, CL3, CL9, CL11.

The proposal by reason of its bulk, height, mass, scale and proximity to neighbouring boundaries would cause an unacceptable loss of light to 296 Old Brompton Road and 1 Warwick Road and a harmful sense of enclosure to properties surrounding the site, all contrary to Policy CL5 of the Local Plan.

In the absence of a legal agreement to secure the new residential units as 'permit free' the development fails to demonstrate that the proposal would have an acceptable impact on parking pressure in the Borough, contrary to Policy CT1 of the Local Plan 2019 and the Transport SPD. The applicant demonstrated a willingness to enter into a legal agreement during the course of the application to deal with this and, if the development were otherwise acceptable, this could have been secured.

Refused despite pre-app advice
To assist applicants in finding solutions to problems arising in relation to their development proposals the Local Planning Authority has produced planning policies, and provided written guidance, all of which are available on the Council's website, and offers a pre-application advice service. Pre-application advice was sought and provided. Unfortunately, this advice was not adhered to. Nevertheless, the Council is ready to enter into discussions with the applicants through the advice service to assist in the preparation of a new planning application.
