Decision details

This case has not yet been decided.

Decision: Refuse Planning Permission/Consent
Decision date: 20 Mar 2024
Conditions and reasons:

1)

Due to insufficient set back from the front elevation, size and scale, the proposed development would create a dominant and overly top heavy extension which would disrupt the front building line and the visual appearance of the mews and therefore would not comply with the Local Plan (2019), in particular policies CL1, CL2, CL6, CL9 and CL11.

2)

The proposed development by reason of the insufficient set back from the front elevation would create a harmful sense of enclosure to the properties along the mews and therefore would not ensure good living conditions to neighbouring occupiers. As such, the development would be unacceptable and not satisfy Local Plan Policy CL5.

Refused despite advice followed
To assist applicants in finding solutions to problems arising in relation to their development proposals the Local Planning Authority has produced planning policies, and provided written guidance, all of which are available on the Council's website, and offers a pre-application advice service. Pre-application advice was sought and provided in this case. Nevertheless, in the final analysis the application was still refused, with all material considerations taken into account. The Council is ready to enter into discussions with the applicants through the advice service to assist in the preparation of a new planning application.
