The erection of the access structure and the metal wires are considered to be detrimental to the character and appearance of the building, the street and the adjoining Edwardes Square, Scarsdale and Abingdon Conservation Area, and are therefore contrary to Policies contained within the Unitary Development Plan, in particular Policies CD27, CD46, CD51, CD61, CD62 and CD63.

The erection of the access structure and the metal wires would encourage and allow the use of the flat roof as a terrace, and therefore, would result in a significant loss of privacy and residential amenity to neighbouring properties, contrary to Policies contained within the Unitary Development Plan, in particular Policies CD40 and CD46.

The erection of the access structue and the metal wires would create an unfortunate precedent for further applications for the conversion of flat roof areas into terraces on Cheniston Gardens. The cumulative impact would have a detrimental effect on the residential amenity and on the character and appearance of the building, the street and the adjoining conservation area contrary to Policies contained within the Unitary Development Plan, in particular Policies CD27, CD40, CD41, CD51, CD61, CD62 and CD63.
