The proposed roof terrace and associated alterations to the mansard roof, by reason of its detailed design and positioning would result in harm to the character and appearance of the building, the terrace of which it forms part and the Norland Conservation Area. As such the proposal is contrary to policy expressed in the Unitary Development Plan 2002, as amended 28th September 2007, in particular Policies CD27, CD44, CD45, CD46, CD51, CD61 and CD62 and contrary with the requirements of Proposed Submission Core Strategy Policies CL2 and CL3.

The proposed balustrading and doors at main roof level facilitating its use as a terrace, by reason of its elevated location, position and proximity to neighbouring properties, will result in a material noise disturbance to the occupiers of adjacent residential properties and a significant degree of overlooking resulting in a material loss of privacy. As such the proposal is contrary to policy expressed in the Unitary Development Plan 2002, as amended 28th September 2007, in particular Policies CD35, CD40, CD46 and contrary with the requirements of Proposed Submission Core Strategy Policies CL5 and CE6.
