Decision: Refuse Planning Permission/Consent
Decision date: 07 Jan 2021
Conditions and reasons:

In applications where the tree is alleged to be causing either direct or indirect damage (subsidence) the application form (Section 4) requires the following information to be supplied: Subsidence: A report by an engineer or surveyor (to include a description of damage, vegetation, monitoring data (level), soil, roots and repair proposals and a report from an arboriculturist to support the tree work proposals. Other structural damage (e.g. drains walls and hard surfaces): Written technical evidence from an appropriate expert, including description of damage and possible solutions. In this case both types of damage are alleged but the above information has not been supplied. Where damage to a wall is alleged consideration should be given to whether it would be appropriate to modify the wall to accommodate the future growth of the tree - there are numeous examples in the borough of where this has been successfully implemented and the Council can assist by providing photographs of these examples. The tree is a mature specimen with a high amenity value occupying a very visible and prominent position and its loss would have a significant negative impact on the local environment and its enjoyment by the public. The Council considers insufiicient justification has been presented to warrant the loss of this valuable tree which is covered by a Tree Preservation Order.
