Conditions and reasons:

1)

Compliance with approved drawings Except in compliance with condition 3 below, the development shall not be carried out except in complete accordance with the details shown on submitted plans
Reason - The details are material to the acceptability of the proposals, and to ensure accordance with the development plan.

2)

Clarification of what is approved under this planning permission Notwithstanding the approved drawings, this permission solely relates to the change of use and the facade alterations; the timber decking and planters (as shown on ST-[02]-111) do not form part of this planning permission.
Reason - For the aviodance of doubt over the scope of the permission.

3)

Ground floor floorspace The ground floor shall be used only for retail purposes and shall retain a shopfront display to Old Brompton Road.
Reason: In order to ensure the vitality of the District Shopping Centre and to comply with the requirements of Policy CF3 of the Local Plan.

4)

Food and Drink Delivery Management Plan No off-site delivery service shall commence unless a Food and Drink Delivery Management Plan has first been submitted to and approved in writing by the local planning authority. Any such delivery service, including by third party operators, shall operate only in full accordance with any approved details.
Reason - To prevent any significant disturbance to residents of nearby properties and to ensure the safe and free movement of traffic on the highway, in accordance with policies of the development plan in particular policies CT1 and CL5 of the Consolidated Local Plan.

Odour Management Plan The use hereby approved shall cease to operate until an Odour Management Plan has been submitted to and approved in writing by the local planning authority and the measures within this plan have been implemented in full, or else an alternative Odour Management plan shall be submitted to and approved in writing by the local planning authority. The measures suggested in the plan shall be retained for as long as the use operates. The mixed use hereby approved shall not operate otherwise than in accordance with the details so approved in the Odour Management Plan.
Reason - To prevent any significant disturbance to residents of nearby properties and comply with development plan policies, in particular policy CL5 of the Consolidated Local Plan.

Commercial cooking No commercial cooking is permitted on site under this permission. No fumes or odours from cooking shall be detectable at the property boundary. If at any time the extraction plant is determined by the local planning authority to be failing to comply with this condition, it (or the source device) shall be switched off and not used again until it is able to comply.
Reason - To prevent any significant disturbance to residents of nearby properties and comply with development plan policies, in particular policy CL5 of the Consolidated Local Plan.

The advertisements shown on the drawings hereby approved require separate consent under the Control of Advertisement Regulations 2007. Application should be made to the Director, Planning and Place, Town Hall, Hornton Street, W8 7NX before any sign is displayed. The Council has the power to prosecute under the Town and Country Planning Act 1990 for the unauthorised display of advertisements.
