Conditions and reasons:

The proposal in the Operational Management Plan to allow queuing on street, with extension of opening hours by an additional 30 minutes to 11.30pm, would result in unacceptable increase in the potential for noise disturbance to the residents of Kensington Square, likely to harm the living conditions neighbours should reasonably expect to enjoy and contrary to the Development Plan in particular Local Plan policy CL5.

In the absence of agreed obligations under S106 of the Town and Country Planning Act 1990 which would secure necessary mitigation measures and infrastructure which are necessary to make the development acceptable, the proposals are contrary to the Development Plan, in particular London Plan policy 8.2 and Local Plan policies C1 and CT1 as well as the Planning Contributions SPD.
