The proposed intensification of use within the rear open area to these restaurant premises would result in an unacceptable degree of harm to the living conditions that residents of adjacent and nearby properties should reasonably expect to enjoy, particularly with regard to noise and disturbance. As such, the proposed development is contrary to policies of the development plan, in particular Local Plan policy CL5 and the Noise Supplementary Planning Document adopted 21 May 2009.
