Conditions and reasons:

1)

Period of use The use and associated structures, plant and disabled parking hereby permitted shall be retained for a limited period of no more than 41 days each year, until 2025 (inclusive). By the end of the specified period each year, the buildings shall be removed, the use discontinued and land shall be restored to its former condition.
Reason - The form and appearance of the structures and use is out of character with the surrounding area and is permitted for a limited period only because of the special circumstances of the application.

2)

Compliance with approved drawings The development shall not be carried out except in complete accordance with the details shown on submitted plans
Reason - The details are material to the acceptability of the proposals, and to ensure accordance with the development plan.

3)

Restoration of Site Within 10 days of the cessation of the use following the Global Champions Tour, the grass areas shall be re-seeded in order to reinstate to their former condition, as existing prior to the fourth Thursday in April of each year (commencement of Chelsea Flower Show set up).
Reason - To ensure the full reinstatement of the grass areas as quickly as possible, in order to restore the green setting to the listed buildings and enable full leisure use of the South Grounds.

Protection of trees The trees on the site at the date of this permission shall be protected against damage in accordance with the Arboricultural Method Statement and Tree Protection Plan, reference SJA ams 23575-01a, dated December 2023 throughout the period of building and other operations pursuant to this permission, including site preparation.
Reason - To ensure that the trees are adequately protected, to safeguard their contribution to theÿappearance and amenity of the area and accord with policies of the development plan, in particular policy CR6 of the Consolidated Local Plan.

5)

Chemical Storage No chemicals including diesel tanks are to be stored within 15 metres of the trunk of any tree existing on the site.
Reason - To ensure that the trees are adequately protected, to safeguard their contribution to theÿappearance and amenity of the area and accord with policies of the development plan, in particular policy CR6 of the Consolidated Local Plan.

Protection of trees during construction - Visits Required The tree protection and remedial worksÿfor the 2024 Art Fair shall be carried out in accordance with the recommendations of the Arboricultural Method Statement and Tree Protection Plan reference SJA ams 23575-01a.ÿÿ ÿ Prior to the commencement of works forÿArts Fairs subsequent to the 2024 event, aÿreport by a suitably qualified arboriculturalist shall be produced and made available to the local planning authority. ÿThe report shall assess the condition of the trees, set out any necessary amendment to the Arboricultural Method Statement, and provide details of any remedial measures identified by the report as necessary in the interests of the health of the trees, together with the dates by which the measures shall be carried out. ÿ ÿ The tree protection and remedialÿworks shall be carried out in accordance with the recommendations of the report. ÿ
Reason - To ensure that the trees are adequately protected, to safeguard their contribution to theÿappearance and amenity of the area and accord with policies of the development plan, in particular policy CR6 of the Consolidated Local Plan.

7)

Hours of operation The hours of operation for use of the 2023 Art Fair to the public for each of the six days of the event shall be as follows: ÿ 27 June 2024 - 08.00 - 00.00; 28 June 2024 - 08.00 - 23.00; 29 June 2024 - 08.00 - 23.00; 30 June 2024 - 08.00 - 23.00; 1 July 2024 - 08.00 - 23.00; and 2 July 2024 - 08.00 - 23.00. ÿ Prior toÿthe commencement of Art Fairs subsequent to 2024 event, the hours of operation for each day of the event shall be confirmed inÿwriting to the Local Planning Authority.
Reason - To safeguard the amenity of nearby occupiers.

8)

Noise from building services plant and vents Noise emitted by all plant hereby permitted, when operating in isolation or concurrently, shall not increase the existing lowest LA90(10min) background noise level by more than 2dB at any time when the plant is operating. The noise emitted shall be measured at 1.0m from the facade of the nearest residential window or at 1.2m above any adjacent residential garden, terrace, balcony or patio. The plant shall be serviced regularly in accordance with the manufacturer's instructions and as necessary to ensure that the requirements of the condition are maintained. If at any time the plant is determined by the local planning authority to be failing to comply with this condition, it shall be switched off upon written instruction from the local planning authority and not used again until it is able to comply.
Reason - To prevent any significant disturbance to residents of nearby properties and comply with development plan policies, in particular policy CL5 of the Consolidated Local Plan.

9)

Hours of Works During the construction and deconstruction of the Fair, no works shall be undertaken outside the hours of 07:00 to 23.59. Noisy works (defined as those which are audible at the site boundary and including noise from the use of vehicles at the site) shall take place between 08:00 hours and 18:30 hours Monday to Friday and not at all on Saturdays, Sundays or public holidays.
Reason - To prevent any significant disturbance to residents of nearby properties and comply with development plan policies, in particular policy CL5 of the Consolidated Local Plan.

10)

Hours of Servicing Notwithstanding any other hours stated in the submitted documents, the servicing of the Fair hereby permitted shall not be carried out between 20.00 hours and 07.00 hours the following day.
Reason - To safeguard the amenity of neighbouring property.

11)

Parking Restriction No parking shall be provided on the grounds of The Royal Hospital South Grounds for the patrons, organisers or exhibitors, except for disabled and reduced mobility drivers as detailed in the Transport Statement by Caneparo Associates dated December 2023.
Reason - To ensure that the development functions satisfactorily and to protect the safe and free flow of traffic.

12)

Traffic Management All traffic and travel to the site during the 2024 Art Fair shall be managed in accordance with agreed Transport Statement, Event Travel Plan, Construction Transport Plan, Construction Management Plan (Caneparo Associates, December 2023 and Event Safety Management Plan (20-20 Events Management Ltd, 8 December 2023) as approved. ÿ Prior to the commencement of works for Arts Fairs subsequent to the 2024 event, the applicants shall submit an updated Transport Statement and Site Management Plan in writing for approval by the Local Planning Authority. The traffic management shall cover the following: Identification of key strategies which seek to minimise the impact of traffic associated with the fair on the road network and to control vehicle access and egress to the site; Identification of the access and egress points;ÿ Details of operational times;ÿ Publicity about public transport facilities available for visitors;ÿ Details of pedestrian access and egress within the site both during build up and breakdown, and during the fair;ÿ Traffic management outside the application site;ÿ Monitoring of both vehicle and pedestrian arrivals and departures during build up and break down; All traffic and travel to the site during the Art Fair shall be managed in accordance with the agreed plan. ÿ
Reason - To ensure that development functions satisfactorily and to protect the free and safe flow of traffic on the neighbouring highways.

13)

Tree protection during construction - Details required The development (preparation, set up, break down and any other operations on the site including the erection of hoardings, site cabins, or other temporary structures) for theÿ2024 Art Fairÿshall be carried out in accordance with the full particulars of the tree protection method(s) as approved in the Arboricultural Method Statement (SJA, December 2023).ÿ ÿ Prior to theÿcommencementÿof works forÿArts Fairs subsequent to the 2024 event, fullÿparticulars of the method(s) by which all existing trees on the site andÿadjacent land are to be protected during site preparation, set up, break down and other operations on the site including the erection of hoardings, site cabins, or other temporary structures, shall be submitted to and approved in writingÿby the local planning authority and the development shall be carried out only in accordance with the details so approved. ÿ
Reason - To ensure that the trees are adequately protected, to safeguard their contribution to the appearance and amenity of the area and accord with policies of the development plan, in particular policy CR6 of the Consolidated Local Plan.
