Conditions and reasons:

The proposed development would, by reason of its scale and massing, result in a significant, noticeable and unacceptable impact on the level of daylight amenity which is currently enjoyed by occupiers of 1 and 2 Charles II Place. The proposal would fail to secure good living conditions for occupants of 1 and 2 Charles II Place, and in the absence of sufficient benefits to outweigh the identified harm, the proposal is contrary to policy CL5 of the Local Plan 2019 and guidance contained within the NPPF with regard to the consideration of the development as a whole and the use of conditions and the consideration of the development proposals as a whole.

The Applicant has failed to agree to enter into a legal agreement to secure necessary associated infrastructure improvements for the development. As such the proposal is contrary to polices C1 and CT1 of the Local Plan 2019, and the guidance contained within the Council's Planning Contributions Supplementary Planning Document adopted September 2019.
