The development fails to comply with the limits and conditions of Class G.3(b)&(c) of Part 14 of Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 and is therefore unlawful.

Condition (c) of Class G.3 of the GPDO states that development is permitted by Class G if the equipment is so far as practicable sited so as to minimise its effect on the amenity of the area. In this case, the equipment is sited on a flat roof area directly behind the main front ridge line and for this reason is exposed to a number of private and public views within the vicinity of the site, rising above the highest part of the main roof. The unit could have been sited in a more discreet location at this property (behind the solid enclosing walls of the property's rear first floor level roof terrace area, for example). It has not, therefore, been installed so as to minimise its effect on the visual amenity of the area and is for this reason it does not comply with Ciondition (c) .
