Conditions and reasons:

The tables and chairs hereby permitted shall be retained for a limited period only until 30 September 2006, on or before which date, the tables and chairs shall be removed, the land restored to its former condition and the use discontinued. (C67a)
Reason - The form and appearance of the tables and chairs is out of character with the surrounding area and is permitted for a limited period only in order to assess their impact on residential amenity. (R67a)

2)

No more than four tables, each with four chairs shall be placed on the pavement at any time. The tables and chairs shall not extend more than 1900mm from the frontage of the premises at any time. (C67d)
Reason:- To enable the free passage of pedestrians on the public footway. (R67d)

3)

The use of the footway for the placing of tables and chairs shall only be between 08:30 hours to 20:30 hours (Monday to Friday), 09:00 hours to 21:00 hours (Saturdays) and 09:00 hours to 21:00 hours (Sundays) Outside these approved hours the tables and chairs shall be removed from the public highway and no customers shall be served on the public highway. This permission shall be personal to Capro Ltd. T/A Luscious Organic and shall not enure for the benefit of the land. (C006)
Reason - In granting this permission the Local Planning Authority has had regard to the special circumstances of the case/applicant, and considers that use otherwise than by Capro Ltd. T/A Luscious Organic would have had different implications, and would be likely to have resulted in planning permission being refused. (R006)
